Resolving conflict & managing people

What is an investigation?
When a company requires an investigation into challenging and sensitive workplace issue, grievances or allegations of misconduct, it is imperative to complete it quickly and confidentially to mitigate any negative impact on the both employees and business (both from a productivity and wellbeing point of view).
When considering an investigation, it is critical to protect the employee and employer that the processes are followed wholly and correct. This also essential if the case were to go to before an Employment Tribunal. Similarly grievances made by employees that have not been properly investigated store up future problems for disgruntled employees or tribunal claims.
An independent investigation should end with conclusions and guidance, that provide you with a structured assessment of options for a more accurate and secure strategy of what to do next.
What I can offer?
Firstly, I believe that being "an external" allows for rapport building, and complete fairness with confidentiality which are important facets to get to the dark spots of all investigations.
After an initial session, I will provide a terms of reference including background, objectives, referencing codes of practice, relevant internal policies (if none in place, use ACAS) and data protection.
In my investigation I will
-
gather balanced and specific evidence with key pre-agreed employees
-
decide if there is a case and identify issues or needs to be addressed (it’s not about guilty or not guilty).
-
based on investigations findings, provide guidance on next steps
-
Finally, depending on the scenario, be able to see opportunities for parties to find a resolution.
